Agreement to Terms

By accessing or using the services of The Gift Design Studio LLC (“we,” “our,” or “us”), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

Services Description

The Gift Design Studio LLC provides web design, Wix website development, AI-powered design services, landing page creation, brand visual direction, and related creative services. The specific scope of services for each project will be outlined in a separate project proposal or agreement.

Project Agreements

Each project will be governed by a separate project proposal or agreement that outlines:

• Scope of work and deliverables
• Timeline and milestones
• Payment terms and schedule
• Revision policies
• Intellectual property ownership

Payment Terms

Payment terms will be specified in each project agreement. General terms include:

• A deposit may be required before work begins
• Payments are due according to the schedule in the project agreement
• Late payments may result in project delays or additional fees

Intellectual Property

Upon full payment, clients receive ownership rights to the final deliverables as specified in the project agreement. We retain the right to showcase completed work in our portfolio unless otherwise agreed upon in writing. Any pre-existing materials, tools, or methodologies used remain our property.

Client Responsibilities

Clients agree to:

• Provide necessary materials, content, and feedback in a timely manner
• Ensure all provided content does not infringe on third-party rights
• Make timely payments according to the agreed schedule
• Communicate project requirements clearly and promptly

Revisions and Changes

The number of revision rounds included in each project will be specified in the project agreement. Additional revisions or scope changes may incur additional fees. Significant changes to project scope after work has begun may require a revised agreement and timeline.

Confidentiality

We agree to keep confidential any proprietary or sensitive information shared by clients during the course of a project. This obligation survives the completion or termination of any project agreement.

Limitation of Liability

To the maximum extent permitted by law, The Gift Design Studio LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to the use of our services. Our total liability shall not exceed the amount paid for the specific service in question.

Termination

Either party may terminate a project agreement with written notice. In the event of termination, the client shall pay for all work completed up to the termination date. Termination terms specific to each project will be outlined in the project agreement.

Governing Law

These Terms of Service and any project agreements shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.

Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after any changes constitutes acceptance of the new terms.
